Default Verbal agreement gone bad

A friend of mine made a verbal agreement to return a check that I wrote him several months ago, he did so, I thought, all ripped up and attached to a corkboard with my name on it. It was ripped so small I couldn\'t even try to confirm it was that check. I assumed it to be that check as he said and lead me to believe that it was. Since he was a friend I trusted him and made no efforts to cancel that check. He recently just cashed out. Can I take him to small claims? What will the courts say? What are my odds of winning my case?
