In process of a divorce, court has granted order for respondent to pay
9500.00 back to applicant for costs incurred during marriage. Both parties are on a loan for a vehicle in which the respondent has possesed since date of purchase. respondent has recently totalled the vehicle and states to the applicant he is claiming bankruptcy. applicant reposses the vehicle into storage. respondent has missed 3 conseq pymts, bank states they will take action. respondent fails to provide insurance on vehicle. loan is worth 18500.00, vehicle is estimated to be worth 5000.00 due to extreme damages. Mechanic that appraised the vehicle is under the impression that the respondent totalled the vehicle with intent of making the applicant pay the loan in full. said vehicle ownership is in respondents name,but loan with bank is in both. bank states its a secured loan. applicant has paid the pymts that were in arrears. how does the applicant file to change ownership and recover costs of vehicle to be repaired and loan difference of vehicle worth verse loan amount? If the respondent claims bankruptcy in which stated he will, will the applicant be responsible for the entire loan plus damages to vehicle? |
