Default Noise Disturbance

I live in a condo building consisting of 163 units and 6 floors. I live on the 4th floor and the person who lives on the 5th floor above me plays his music loudly. I have had the call the police 30 times for noise disturbance but there is no ticket in the city of Chicago that can be issued for noise. The building is not 75% sold so the developer is the board right now, they are aware of the problems but have yet to fine the owners on the 5th floor. Can I sue for some of my assessment money back along with some mortgage money back for not being free of unreasonable levels of noise and for pain and suffering?

Normally no--but you can take the other person to court and try to get a judge to order them to quiet down or face contempt.
