Broken little finger... I am getting sue for $3,000 of medical bills
My 10 years old son is in team sport, one of the boys got hurt in the locker room he broke his little finger and I am getting sue for $3,000 of medical bills(?). In the locker room my son was walking and one boy asked him if he wants to see a clogged toilet my son said, “NO” and the boy said go get someone who wants to see it. So my son went to the showers and asked first boy he saw if he wants to see a clogged toilet and boy said yes. When he got to the toilet to look the other boy closed door and broke his finger. Parents filed a police report, case was suggested to the TEEN court by prosecutors office but after I talked to the lady from the TEEN court she said write letter of apology and she will dismiss case because the boy or his parents lied about how it all happened they said that the boy was dragged from the shower, pushed into the toilet’s stole and his hand was hold and door was slammed on his finger on purpose. My son wrote a letter saying that he is sorry that the boy got hurt, but now we are getting sued in the small claim court. I have few questions should I counter sue them, can they sue me and the other family for the same medical bills and why if they lied to police officers they are not getting any punishment?

I wish to inform you that civil and criminal are two separate matters. When the police report was lodged it was a criminal matter. The Court accepted the apology of your son and closed the matter. If the other party has filed a claim in the Small Claims Court, the burden of proof is on that party to prove the claims being made by that party. You may provide evidence to show that your son is not responsible for the injury caused to the other party. You may show to the court that the other party spoke lies in the court and to the other party. The court will consider all the facts and decide the matter.
