Wa resident trying to sue T-Mobile.
Hello, my girlfriend is trying to take T-Mobile to a small claims court. We just don't know what the process is here in the state of Washington. Here's the story: She had three lines, under a family plan, with her sister and mother. She cancelled her mother's plan in late 2011. In January, she cancelled her line and her sister's line. At the time, her mother's line, her sister's line, and her line was not under any contract. They were paying month to month. T-Mobile sent her a $400+ bill. My girlfriend went the Better Business Bureau to file a complaint against T-Mobile. Throughout this process, she kept asking the BBB to ask T-Mobile for a detailed account of all they were charging her. Since she cancelled her account, she could not access her online T-Mobile account. It has been a couple of months and we have not heard anything from T-Mobile. All she gets are calls from a collection agency to pay the bill. A T-Mobile executive has called to inform her to pay the bill. The BBB has closed her case and left it unresolved. So, she hopes to take them to court. Any suggestion?

I wish to inform you that your girlfriend can give a notice to T- Mobile that if they do not settle the issues then a lawsuit will be filed. If the matter is not resolved then a lawsuit can be filed in Small Claims Court. Your girlfriend can go to court and have a Notice of Small Claim form from Court clerk. She may then fill the form and bring two copies of the form to court and file it. After form is filed then she will be required to serve it on other party. She will get a trial date on the day of filing notice. On trial date she can present eidence in her support and then court will decide the issue.
