Lightbulb she is 15 and married

my daughter was attacked and strangled by a 15 yr old girl. We have been to court and she pled guilty. We are seeking damages such as med expenses and pain and suffering. I know you can not sue a minor. You have to file against her parent or guatdian. She is now married. Does that make her 19 yr old husband her guardian. She no longer lives w her parents.Is he the one I file a claim against on her behalf??/

You can still name the parents normally--they were the ones responsible when it happened.
