Unhappy Paid for services never rendered

Hi!
I am trying to avoid small claims court, and I am not sure if I have a case.
It's a long story, but a chiropracter had convinced me that I needed to prevent spinal problems in the future by putting the natural curve back in my spine. there was nothing wrong with me at the time. However, he also convinced me to pay the full amount up front. I only went to about a month's worth of sessions, and then after about 6 months was no longer able to continue the service. I sent a letter after about 7 months, and received no answer. Another year passed when I noticed that I never received a refund. I called them and was told that if you don't let them know within 60 days of "discontinuing", that they keep the remaining money. I am not expecting a refund of services I already had obtained, but they are keeping about 1,000 dollars worth of services that I never received. The actual agreement that I signed did not mention the 60 days, but there was a separate peice of paper that I did not sign, which did mention it. I feel there is something inherently wrong with this and I am wondering if I can fight this in court, especially since the policy is on a page that I did not sign. Any help is appreciated. Thanks!!

Default Re: Paid for services never rendered

You can at least tell them you will file in small claims; they may compromise. Otherwise you need to file. That should be refunded to you.
