Question COLLECTION OF MONEY LOANED

In 2003 I made a loan to a friend in the state of Indiana for $10,000.00 I had my attorney draw up papers for a Promissory Note that promises my friend to pay me back $15,000.00 one year later. I had my friend and his mother sign the note, I also have copies of the original check that I gave him from my credit union. Since then he and his mother have moved to California and I have moved to Florida. I have spoke to him and his mother several times, but I always get the run around. I dont know where to start - this all began in Indiana and now we are all in different states. Do I persue Small Claims Court? If so what state? I only have his mothers phone # and she wont take my calls! I do know the name of the business she owns in California... Can I collect the $15,000.00 owed / more/ or only the original amount - or any at all????? please help I could really use this money right now!!!

Based on what you say here, you could file suit against him (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney but amounts are limited...you could try to collect all of the costs and damages that you suffered due to his behavior... you can collect whatever is due at this point.
