Thank you in advance for an ideas or suggestions.
In September of 2006, I sold a vehicle with a Bill of Sale and a promissory note that contained an agreement to begin payments of $284/month for 24 months starting December 1st,2006. No payment has been made or attempted. Under the promissory note, it agreed that if payment is defaulted on, the buyer agrees to give back the vehicle to the seller. I have had some success early on contacting the buyer, however his number is disconnected and does not reply to his emails. As a result, I sent a Notice of Default Demand letter. I live in the Minnesota, I assume if I do not hear from him, I proceed on to small claims court. My question is, if it does go to court, can I ask the court to have the buyer hand over the keys until payment can be made? Or can I hire a tow truck and have them repossess the vehicle that way? Any other ideas or suggestions on how to handle the matter? |

You can try yes. The court may however just award you money damages instead.
