Question rental equipment

I rented a floor sander when finished loaded it on a trailer to drive it back to the rental company , 4 blocks away, on way lady went through stop sign and i laid on breaks = sander went air born.... did not land well! talk to the rental place he said i didnt tie it down his insurence wouldnt cover it i owe him 3000 dollars , i didnt tie it i used ratchet straps . I tried to turn it into my insurance they said sure they just needed something from him that said his insurence would cover it . He refused to give me anything they came back and said his should cover it and they dont cover rental stuff then . now hes sueing me for the cost of a brand new sander even tho the one i wrecked was 4 years old or more

You can bring the insurers and the lady and all parties into that suit and let the court decide who has how much fault for the accident. Seems each may have some fault here.

wish I could bring the lady in but she didnt stop and at the moment with the floor sander flying past my car i didnt get her plates
