Confused Didn't completed transaction on a sailboat

Thank you to everyone who’s reading my case.

I’m a U.S. citizen living in Canada since a while and I must admit I’m a little bit disconnected from rules and law of our country. Let me explain my story.

Last month, me and my friend have bid and win on a sailboat without mast on eBay located in Mystic CT. Before sending money I arranged a meeting with the seller to check the sailboat and verified that everything was like He said. So on Saturday 22nd of august me, my girlfriend and my uncle, my friend wasn’t there, meet the owner on is sailboat. Even if the sailboat was damage at 3250 USD it was a good deal for us. Everything was ok for me so we completed an official bill of sale of Connecticut (form: BILL OF SALE H-31 REV. 10-2001), I’ve kept the original and scan a copy for the seller. We told him that we want to pay by PayPal but he refused. He wanted to be paid by cashier check. We told him that was going to take more time and probably take more than 7 days requested by eBay to pay for an item. At this time there were no problem and the seller verbally agreed.

The week after on Tuesday we send him a check of $3250 USD with a postal tracking number. On the next Saturday, one week after we meet the seller, the check was received at the postal office of mystic so I called the seller to inform him that the check was in mystic but at this moment he told me that he doesn’t want to complete the transaction because my check was late. That was the last time a talk to him. Further exchange was on eBay. The check was return at least but with the exchange rate, postal tracking service and weekend spend to go see the boat, we lost a 500$ in the adventure and no boat yet.

Now my question is what can I do next? Can I go to the small claims court and request completion of the transaction and finally put my hand on the sailboat. If you think that I can go to the small claims court, what’s the procedure? My worst fear is that may be someone else offers him more money for his boat and sold him the boat. If it’s confirmed, can I still do something?

File in small claims for the money lost and file a police report for fraud if you suspect fraud in any way.

I don’t think that there’s a fraud in any way but at the end, I want this boat. Can I force him to complete the transaction with the small claims court?
