CA Hotel Occupany Tax Overcharged

We rented a hotel room in San Diego, CA for over a year. We left the place not looking so nice, and now we\'re being sued for: carpet replacement, cleaning and 1 week of lost rent. My thinking is this: in order to get the week of lost rent, the hotel would have to prove that ALL the other rooms were occupied AND that they turned people down because of cleaning the room. Is this correct? In addition, I feel that the hotel breached our contract by allowing us to stay more than 28 days, which is not permitted per the contract. Further, I am under the impression that because we were allowed to stay more than 28 days without moving rooms and the hotel collected tax on our rent, we are owed all back taxes paid past 28 days? May we countersue? Because they breached, are we responsible for damages?

They normally will not get lost rent unless the rental situation is as you described.

But you are responsible for any unreasonable wear.


You will likely not get taxes...they paid them and the government has them. The room is still a hotel room even if you stayed there longer.
