Normally small claims decides only damages and does not give orders that you have to perform.

But some small claims courts reach beyond that job and will give order such as: return the cat.

It happened in Austin just last week in our court. So it is worth a try. Or the judge could say e.g. return the cat or pay 5000 dollars damages.

A cat is considered "property" in the legal system and therefore if ownership (vet bills and purchase receipt) can be provided, then you should be able to retrieve the property. As for $5,000... not so much. The judge can go two ways. If you do prove ownership, they may either make the cat be returned or reimburse you for the cost of the property. If the judge chooses to not return the cat, former vet bills and the purchase price can be recovered.

I hate it because I am an animal lover and my ex stole my dog. I understand your pain but again, in the eyes of the judicial system, pets are only valued as property and no monetary damages for attachment can be collected.
