Default Ebay seller in need of advice.

I sold a double buggy online. I listed the item as faulty. This is my exact wording

" Graco quattro duo buggy. In overall very good condition, There are a few faults but none affect its use.
There are some minor marks on one side of the frame and a back wheel hub cap is missing (common) And one catch on the back seat needs replacing, although it still works. Just cosmestic really.
Not much wear on the wheels and a fantastic double, I found this amazingly easy to steer, I have had lots and i have to say this is one of the best.
Includes 2 footmuffs and a raincover"

The buyer has decided that she is going to take me to small claims because she feels that i misled in my auction because i didn't state what the fault was or how much it was going to cost to repair. There is an ask the seller link by which she could have asked any qustions before she bought the item. The fault is 1 of the 2 clips that hold the seat in upright is broken. The seat does still stay up.
Where do i stand?

Did your description state sold as is and no refunds? Ebay auctions are legal binding contracts and if this was stated then your buyer needs to be aware of this.

One day, another eBay member decided to steal my daughter's designs with some crafts she was making, so my daughter tried to go to Small Claim's Court on her to have this woman stop. The buyer lived in another state. My daughter filed a Small Claim's action and the buyer answered the court saying that she lived in another state and asking for the case to be dismissed. The court dismissed the case saying that the court felt it had no jurisdiction over the two. My daughter lost her business, because this woman stole every design she had. eBay did nothing, but tell my daughter that she had 10 days to file in Federal Court or they would allow this woman to continue listing and making the items. My daughter did not have the money to hire an attorney and/or go to Federal Court, so this woman stole all of my daughter's designs and to this day stole her customers.

Call Garfield Hts Muni court and simply ask for a copy of the defendant's response (you will most likely have to pay for a copy fee and maybe postage) and when you receive your Small Claim's Action, just send in the same thing my daughter's defendant did and it should be dismissed.
