my friend coco
2 1/2 to 3 years ago my wife's Aunt D received a bird to find a home for from a mutual friend of a man that passed away. When the bird, an African Gray named Coco was brought to our apt. he bit me and took to my wife. After a couple of weeks he decided to adopt and bond with me. Now he bits everyone else but me. Coco had to have surgery for a growth in his neck (grown around his juggler vein) to have it removed. During his vet visits and his surgery I was in contact with Aunt D and she made no attempted to pay for any of his bills and she never said anything about us just watching coco, however we could not afford to pay for his surgery all at one time so she lent us the money which we paid back. Aunt D has been kept in the loop the whole time we've had Coco, I personally had conversations a couple of dozen times and more with her and my wife. Now my wife has filed for divorce and Aunt D is saying that she told Kris (ex-wife Tobe) that we were only watching the bird for her and it belongs to her. She wants to keep the bird in the family. Neither her (ex-wife) or Aunt D ever told my anything about us just watching the bird. If they had we would not still have coco. we would have given him back 2 1/2 years ago. Because it is not fair for the care giver (me) or the bird. The only reason this has come up is because of the divorce.
She (Aunt D) is now suing me for 1800 dollars, the return of the bird and court costs. Does she have a case? Or did she give up coco as I say she did. I do have a witness that can attest to the fact that she (my ex- to be) said a number of different times that coco was my bird or Coco's daddy's bird. Does this help? You may explain you were never told it was a loan and you have put a lot of time and money into the bird. The court will almost surely leave the bird with you.
