Owed $4000.00 from 10 years ago

My sister borrowed $4500.00 from me for a criminal case she was involved in 10 years ago to keep herself from going to prison. She was told it was a loan and that she had to pay it back. She only paid back $500.00. She and I have since had a falling out over the years. Recently, 10 months ago, she sent me a letter and asked me to come to her baby shower 4/1/06, because she had a "personal and financial amends" she wanted to make to me. After she said her peace, I told her that I held no grudges, but that there was no way we could return to the same relationship we use to have. At that point, the conversation was over as far as she was concerned and she said she'd speak to her husband about paying back the $4000.00, and they'd either pay it in one lump sum or make payments. I haven't heard from her since. It's been 10 months. My question is, is there a statute of limitations on loans, or can I go ahead and take her to small claims court.

But even if the SOL applies it is worth suing as she has to assert the defense and may not do so--and in some cases a payment etc. will start the time running again.
