how to serve in California?

I am suing a local furniture store that seems to have a habit of taking orders but never delivering 100% of the ordered furniture. They wrote me a check to compensate me, but I found out they wrote it from an old account that has no money in it -- so insufficient funds to pay me. Also, the check is from a company that no longer owns the furniture store. Somehow they had old checks from the previous store -- or they just changed their business name. How do I serve them? Under the old business name or the current one? And did they just cleverly avoid liability somehow by writing me a bad check from a company that doesn't seem to have any money? Both old and new company names state they are "doing business as" a 3rd name.. which is the name I thought I had been dealing with all along... arrgh!

Name both in the suit and argue they are in effect the same business.
The judge should agree and the culprits will have to defend, explain etc. If you think they have done it a number of times, then file a police report as well. World Law can likely help if you email them. |
