My son (who is 23) was at a friend's home and was told he could ride on their ATV. While riding on their property he hit a pothole and was thrown from the ATV and the ATV flipped. The owner of the ATV wants my son to pay for the ATV which he says is totaled. He still owes money on it evidently and wants my son to pay off the balance owed of $2500. Since my son had permission to be riding it and was on their property, and wasn't aware of the potholes, wouldn't they instead be liable for his injuries and medical bills? I don't think my son is liable for their ATV, is he?

Yes they are liable not him--unless he was purposely misusing it,
