PLEASE HELP ME

In August of 2007 I had an accident in my Toyota Tundra. My neighbor who works for Ford but does body work on the side from his place of residence offered to fix my truck for 6500.00 after looking at it. The verbal agreement was made and I gave him a check for 4500.00 and he stated I would get my truck back within 2-3 months and would pay the balance when finished. This is where the problem starts, it has now been over a year and he refuses to return my truck stating it is not finished yet. I want my truck as is due to the fact that he continually states it will be ready "next week" . I have been more than patient trusting him to do the work. At this point he is refusing to give me the truck stating he has put much more money into it. I asked for receipts and he states he does not have any. I called the police. They came out and told me it was a civil matter and to take it to small claims court. I really need some advise. I want my truck back and he has it locked up so that I can't even have it towed.. Please help
