refund from ebay seller

paid for ebay item, received it and it was not in the condition as described, advised seller who agreed to refund my money, item was return, ebay dispute opened by seller and closed by ebay, seller again agrees to refund money, but did not send check, now no answer to my emails, placed call to seller's phone, no answer as of yet, I live in California seller lives in Ohio, What do I need to do to get my money back? Amount is over $500.00.

How did you pay? If you paid through Pay Pal, contact Pay Pal- they have a special fraud/abuse program for situations just like this. If you paid with your credit card, do the same. If you sent them a check or money order, you will probably have to take them to small claims court.
