Default damaged wedding gown

I found the gown of my dreams at a wedding boutique. Didn't purchase the gown the day I saw it because it had a defect. Two weeks later I get a voice message that they are having 1/2 off all in-stock bridal gowns. I called to see if they had gotten that particular gown back in without a defect. They informed me that they had not, however, their other location had one. They had the new gown sent to the location where I originally had been - again at 50% off. When it got there, there was a big stain on the front. I told them that I did not want the gown any longer. Of course they had taken my credit card number and charged it to my card. They then said that they would try and get the stain out. The next call was to say that the stain was out, but there now was a ring around the spot where the cleaner had been. I said I did not want that dress. They then called again saying that the stain was totally out and you could never see where it had been. I told them to credit my card and that unless I could see it (I live 1 hour away), I wasn't comfortable purchasing the gown. At that point I thought the ordeal was over. They had encouraged me to at least stop in and they were sure I would want the dress, now that the stain was gone. Two weeks later I was going throught their town on the way to another event and stopped in just to take a peek at the dress. Sure, the stain on the front was gone, however, there was a stain on the back. Now they are telling me that I cannot get a refund. They had not credited my credit card (I got my statement this morning and there was no credit). I NEVER signed the contract they had sent me in the mail and the dress has never been removed from their store. What can I do?

Your card company shoud reverse the charge.

Tell them you never purchased it as the item was defective --

You may also sue the stote in small claims if they damage your credit.
