I sold a portable garage on ebay (brand new) to Richard Cottrill in Watchung, NJ. This guy bought a unit from me that was $499 including shipping. The auction clearly states that we get backed up in the fall so order early. It took three weeks to get his item shipped via truck.

He filed a complaint with Paypal on the day we shipped it and subsequently refused the delivery to the trucker. The trucker returned the item to me.

Mr. Cottrill requested a 100% refund when I had to pay two way freight. Then he left me negative feedback calling me a thief saying I never shipped the goods.

We escalated the dispute to a claim with Paypal and they sided with Cottrill saying that I had possession of the merchandise!!!! But now I have a portable garage that has been handled twice by a trucking company and no longer looks new (so I don't think it can be sold as new), $150 in freight charges AND negative feedback.

Ebay will not remove the feedback because they say I have a right to reply!!!

Is there any precedent to sue ebay civilly to have this feedback removed?
