My brother loaned a woman $500 and had her sign an agreement to repay by a certain date. She did not repay. He took her to small claims court and she did not appear for the hearing. Judgement was made in my brother's favor. The court has not been able to serve her with the papers as she has supposedly moved from the address we gave them.
Whose responsibility is it to find a new address for her. She does not work so it cannot be delivered to her there. She receives welfare checks and child support. Can the court use those addresses to find her? It seems that the courts point of view is that we need to find her and tell them where she is. What is the legal procedure? Thanks, |
