Victim of Fraud - Any Legal Recourse?
I will try to explain as quickly and efficiently as possible. About a year ago, I began receiving collection notices about bad checks that were being written around the state. Someone had used my name and address and created checks and were writing them at different stores. I worked with the collection agencies and sent them all of the documentation they needed to prove it wasn't me. The checks that were written had a fraudulent Drivers License number as well as the incorrect phone number. It was also drawing off an account that did not exist!! So, while I wasn't out any money, and my credit profile was safe, I did everything I could to help the stores and the debt collectors that contacted me because I didn't want a deputy showing up at my house. I filed a police report to cover me, but when the check notices started pouring in, I was told that the matter wouldn't be investigated because the office was too busy. It's now a year later, and checks that I sent in documentation on a year ago, I am getting calls about. I have once again complied and sent in copies of what I have already sent and ask that the companies please take care of this. So, I guess my question is.....do I have legal recourse to secure compensation for the time and money I have had to put in to get all these things corrected even though law enforcement didn't seem to have the time to investigate? Can I....A.) Bring recourse against the stores that validated the checks? In this day and age, stores like Wal-Mart and Lowes should have the technology to see that a check is trying to be written on a fake account. B.) Bring recourse against the collectors for what is walking the line of being incompetent after sending the same documentation 2-3 times? C.) Is there anyone that has to answer for the time and money I've put into this. Thanks in advance for any advice given.
