Default Parents of special needs child being sued

We (parents) are being sued in small claims court because our special needs
son accidentally broke his teachers glasses while he was in her care at
school. Our son attended this school as a special education child and his
disabilities are well documented there.
Are we responsible for his actions as a child with special needs?
Any advice on the situation or what to do in court would be greatly
appreciated.

The school's insurance should cover that as part of insurance covering accidents. Unless she shows he had legal intent to do a wrongful act, you normally do not pay for that.

That is what we thought and the school says they do not cover personal property? Does the liability then pass to us?

I'm disabled and I have been around all kinds of special needs children as well as adults. In this case, you are NOT liable for anything. The teacher chose to let him in her car, knowing he has special needs. If anything she should have to pay for her own glasses all by herself because it was her neglagence.

Parents are not liable there. That is her job and accidents do happen!
