Non Payment of Wages -- What can I do to recover the money?

I was a truck driver and quit my job because my employer (owner operator) was not paying me. The employer filed chapter 13 before I quit and now has added me to that list. I cant get money owed to me and need to know what my rights are and what I can do to get paid. Also Company that he was leased to has gotten a gag order from his Lawyer not to give us ANY info for mileage we ran or to speak with us. I need advice please!!!! What can I do to recover the money owed to me??

I wish to inform you that you are creditor of the company. The amount of wages which has not been paid to you is the amount due to you. If the company is having assets then you may receive your salary. You may have information regarding mileage from the truck dealer. You can inform model of truck and they will inform you about the mileage of truck. Further you can contact bankruptcy trustee regarding payment of amount due.

It is better to lodge a complaint against the company through employee welfare association if any. You can also gather employees who face the similar situation to make a complaint against the company.

I have asked for payment from my former boss but all he tells me he has no money and to contact his Bankruptcy Attorney. When I call the the trucking company that the truck was leased to they tell me that they are not allowed to talk to me because of the gag order. I also forgot to mention that I was a sub-contractor for this gentleman. He has blocked me at every turn to get the information. It seems that he does not want me to know what the true mileage was that I ran for him.

Im was driving for an owner operator and just recently was told that he was gona patk the truck i was in. He owns three trucks and are leased to the same company.He pays us drivers n cash but hasnt paid me the last two runs i did although he already got paid by the company.....I keep his truck in my fenced yard and my question is.Can i keep his truck legally as collateral until he pays me?
