i am looking to change jobs but i will not get my commission check until a 2 weeks after i leave.
on our compensation plan this year they tossed in you must be employed at time of payment and you can not be a resignation period. My employer is in NYC and I live and work in Texas will they have to pay me? Texas law I found: Texas Labor Code § 61.015. PAYMENT OF COMMISSIONS AND BONUSES. (a) Wages paid on commissions and bonuses are due according to the terms of: (1) an agreement between the employee and employer; or (2) an applicable collective bargaining agreement. (b) An employer shall pay wages paid on commissions and bonuses to an employee in a timely manner as required for the payment of other wages under this chapter. |

If you earned the commission they have to pay; they cannot hold back just because you are leaving. You may sue in small claims if need be.
