Overpaid

Overpaid
I left my previous employer in Jan '07. They just realized May '07 that they overpaid me $800 back in '06. It was an accounting mistake on their part. Am I obligated to repay the $800 since it was their mistake and it was done over 6 mths ago??

Technically yes you do need to repay if you agree it is an error; you can however argue hardship in having to pay all or any substantial portion--saying that it was their mistake after all, and you spent it w/o realizing it was in error, and paying back now would be difficult...they often will not sue or take any further court action in these cases but will try to work something out. They may even settle on a partial amount.

What kind of proof should I ask for?? Right now I just have their word that it was overpaid, nothing backing it up.

Ask for whatever written evidence they have. They have to make the case not you.
