Tennessee. My son works for a restauant in town, he is on salary & he was working on a roof in differnt location to the restauant, he is a cook at the restauant. He fell thur the roof at the new construction site, cut his leg in several places & also tore the ligament behind his knee cap. His supervisor told him not to tell the Hospital he was hurt at the construction site, to tell them was working at the restauant instead, so he did & now the supervisor is not wanting to pay his full salary. He is also soposed to be on restrictions & the supervisor is making him do his regular work for the restauant but not for the construction site. Doesn't have to pay the full salary regardless?

Well for one, his job clasification based one what you just described is not one that is eligible for an "exempt" status. Beyond that, if he was injuried for is outside that for which he was hired for in being a cook, he would still be eligible for Worker's Comp in most instances. Chances is that if the employer has asked him to report it while under a different set of circumstances, then they do not have coverage under that entity which, of course, is illegal.
