crediting salary
I have been presented with a compensation package that includes a base salary paid bi-weekly and incentive pay in addition to the base salary. The incentive pay method that has been proposed is as follows:
Employee will be credited 1/3 of the payment the Company receives from the billed customer. After the 1/3 received equals the Employee's base salary for the billing quarter, any additional money collected as 1/3 the customer's payment shall be paid to the Employee as incentive pay. Question: Is this lawful under the FLSA or any other laws in effect regarding employee compensation? |
