Default unemployeement and workers comp.

My husband got hurt at his job in May. His employer is working with workers comp. and he is getting ready for surgery on his knee. Now his employer has laid him off! Can he apply for unemployeement and have workers comp. at the same time??

He can as to that injury in many cases, yes. Consult with your nearest dept of labor office too!

NO, I dont' think so,
when you apply for unemployment benefit ,
you must be able to work, and available for full time work.

He may want to contact either the DOL or EEOC since he was out due to work injury its possible the lay off was illegal. Unless his employer can show he was due for lay off before injury there coud be a wrongful termination case here. Do not take this as legal advice contact a labor law Attorney and the aforementioned agencies
