Default Garnishment of Wages to cover Employer's mistake to deduct insurance premiums

California -- Early this year, my employer revamped our insurance coverage and premiums. Mistakes were made and the company failed to deduct insurance premiums for 9 months from my paycheck. The entire transitional process was a mess and I was confused from the beginning. The transition roughly coincided with a raise I received and I took for granted my net take home salary.

Now, my company has unilaterally decided to garnish $100 a month off my paycheck until they recover their loss. This creates an extra hardship for me because I also began paying for health premiums I previously thought were already being deducted. What rights do I have?

There should be something to protect you from experience hardship due to their mistake. Your State is not the norm and has some odd laws. You will have to check with the local Department of Labor office to see if there is anything in the State law.

Typically the employer should be willing to work with you to repay the money... at least a good employer. Granted you made a mistake in not examining your paystubs.
