Default where do i stand

Let me give you a brief overview.
In 2004 I had 3 back surgeries. I returned to work after the first 2 and
then again after the 3rd surgery. From 2004 until I had a 4th surgery in
2008 I continued having trouble with my back. Several times I injured it at
work. In 2008 I requested a copy of my medical records from my employer. In those record is a communication from HR to Employee health stating they
could no longer support me in the area I was working due to my back. From
2004 to 2007 I continued working in this area which required me to gown and
put on shoe covers which hurt my back everyday. In 2007 they moved me to a deck job. It took them 3 years to get me out of an area that was hurting my back. I file a workers comp in Jun 2008 and I am now being told the statue of limitation has expired. How can this be, my work kelp me in an area that was unsafe and might have caused my 4th surgery, but because I did not know about this communication I was unable to act. Also how can I have run out of the statue of limitation if this has been an on going issue?

-- It is certainly possible you have a case based on what you say here; you should take a brief description of these events as well as your medical records to an injury attorney and see if the attorney thinks you have a claim; often you need to contact several attorneys to find one to take the case; the review of your case and records is often free and then they will normally take the case on a contingency fee basis if they think you can win; you would pay only if they collect for you...
