Confused Do I have a case?

I am a salary paid employee and I would like to know can an employer deduct any sick or late time from my salary, if so what percentag of that salary should be deducted for sick or late time? Is it legal for an employer to delete a position from any job without using senority as determination of who is to go?

They cannot deduct sick time in that situation normally.

Contact your dept of labor office nearest you to reeport this and discuss.

1. Yes in some circumstances it is alright to deduct from a salaried employees pay. Some of it varies by State but still is legal. In my State, you can deduct for a whole day missed, but typically if they are in to attempt to work and then leaves, it is difficult to deduct those wages.

2. An employer has a right to eliminate a position and the person being "cut" is of their choosing. It usually is based multiple factors but just because someone has more senority doesn't mean they will be kept over someone with less senority.
