Confused payroll deductions

I receive a payroll check bi weekly. I have child support taken out of each check. I went to the Child support dept. to ask why I had arrears they informed me that my support was due by the 20th of each month and I was late. So I was charged $700 interest fees and they dinged my credit. I asked them why they didn't just take out the amount they needed so I wouldn't be late and they responded that by law they can only take up to 50% of my payroll but I could have my work take out the amount needed on my first check of each month so this wouldn't happen again.

I called my payroll clerk to let her know that the support needed to come out of one check...she refused. She would have to remember to do that each month and that wasn't cost effective. I then told her fine then I will go down and pay the balance each month bring her the receipt and then she wouldn't have to take anything out of the rest of my checks for that month, she replied I cant do that either.

I need to know what my rights are. I dont want my credit ruined anymore than it already is and I also don't want to pay more interest fees. Is there any law that can help me fight this?

Thanks
Mike

Default Re: payroll deductions

Why can't you remit one additional payment directly to child services so that you are on track? Your payroll deductions would continue as they are...but that one extra payment would ensure that child services has the right amount on hand so you aren't considered 'late'. Your payroll clerk is correct that she cannot be expected to change your withholding each pay period.
