my friend's family purchased a house in ontario in 1985, due to some legal paper issue, the deed was put on the oldest brothers name, my friends older siblings worked and paid the home of in a few years while the parents paid minor rent and took care of the families other needs. in 92 the older brother had a child out of wedlock, in 93 he passed away, he had no will so all that he had went to his parents and siblings. now the mother to the child wants the property that the whole family worked hard for. does she have a case or does my friend need a good lawyer. thankyou

If two or more owners cannot agree on what to do with a piece of property they may petition the court and the court will order a sale or refinancing etc. so that the one or more may get out of the property obligation and/or the other(s) may keep it etc.--it is often done-- (This is true in some cases even for equitable owners that have paid various amounts etc., but for various reasons, may not be on title.)
You could threaten to take this action if need be. It may cause compromise |
