I signed a 1 year lease for a duplex in August 2005. The following August (2006) I signed another. In the summer of 2006, we talked to the landlord to have them send us a new lease. They never did. We continue to pay and live in the place without a current lease. On December 7, 2007, I sent them a letter saying that we are going to be moving out by the end of the month. They sent a letter back saying that we will not receive our security deposit because we did not give 30 days as stated in the security deposit agreement n the lease. Can they keep our security deposit without a current lease?

If you are now renting month to month you normally do need to give 30 days notice. But you could move out Jan 7 and that may suffice.
