mtg co. foreclosing on home ex got in divorce
Back in 1993, I received a stipulation of property settlement agreement from in the district court of Jo Co KS, naming real property, the legal description along with the property address... to be set aside for my (ex) husband in the divorce, me agreeing to initiate a quit claim deed for transfer of title along with a signed affidavit acknowledging that it is a binding contract (the property settlement issue) irrevocable by both parties, me being free and clear of any right, title, lien, claim or interest signed March 11, 1993 by both my then husband and myself. We divorced, he got the house which he rented out to our sons and their families along with a few other tennants, asking me at one time if I wanted to buy it from him. I had to get my credit report adjusted in 1997 as he was constantly late on the mtg payments and apparently my name was still on the title because late pays were showing up on my credit report. A month ago I get a summons from the District court of WY CO KS stating the mtg co. is forclosing on the property and is naming me (along with my ex and one of our sons) as defendants for the balance of the mtg along with interest and penalties and lawyer fees because my name was on the initial loan application and he (my ex) stopped making payments December 2006. I sent a response back to the court and the attorney for the mtg co. stating my case of the property no longer belonging to me with copies of the divorce settlement docs showing the same. This week I get a follow-up copy of my name on a trial date 10/2007 for the same, acknowledging I responded with 'an answer' and they are continuing with the case naming me along with my ex. I am remarried with bills of our own 1700 miles away. What are my options?
