Confused rail road right of way

I have property in wv that has been in my family since the 1930's or 40's. In 1965 a mobile home was put on the property and various mobile homes thru the years. In 1999 I put a new manufactured doublewide on the lot. In 2006 I was contacted by Norfolk Southern Railroad stating I was partially on their property (right of way)and was given 90 days to vacate. I did consult an attorney at the time and worried my bank account would be drained dry and no money left to move the home. Norfolk contacted me numberous times wanting to know when I would be moving the house. Norfolk also said a neighbor paved over the tracks would be removing the pavement, and various neighbors were parking on their propertty which is not allowed. (the track has not been active since the late 70's) No right of way information is available in charleston wv. I spent thousands and thousands moving the home. Over a year later the neighbor has not removed the pavement from the tracks and others are still parking on rr property. Have I been paying real estate taxes on rr property all these years? Do I have any grounds to file a law suit in regards to being singled out? I'm just not satisfied with the out come. Conrail used to own the tracks and all thru the years never mentioned anything about the right of way, Norfolk purchased the tracks a few years ago.

Default Re: rail road right of way

You could try to argue they abandoned it--you might just win,

have you had a title company review the situation as well?
