condemnation of land for an easement
A well know telecommunications company desires to obtain an easement from me to run fiber-optic cable along a water line already on my property, the water line has an easement, in place before I bought the property. The problem is they want rights to 15 foot wide by 664 foot long strip of my property, forever, to run a 2 inch cable. I have lived here for 22 years and my front steps are but 25 feet from a state hwy, an old historical house that was built before the road was. The state hiway has a 5 foot easement that the Telecommunications co. could use but they don't want to put their cable in the hwy ditch. They want to run it along the water line for safety of their cable. They will probably destroy my front yard. They have offered $1 a foot for fair compensation. This works out to a little over 6 cents a square foot, forever. My condention is 1) they have a ROW with the state hwy, even though it is not their choosing. 2) they could run it across the street on another parties property. 40 There will be instances in the area where they will not be able to run along a water line because one does not exist 3) If they desire the use of my land forever, they need to make JUST compensation.
I have refused to accept their terms and have received a letter stating they
will begin condemnation proceedings if an agreement cannot be reached. In my state condemnation proceedings are with a jury trial. I prefer them not to intrude my land but to either use the st. hwy ROW or other land. What are my options.
