a friend lent me $$. I have been paying her back interest monthly. I told her I would pay her the lump sum when my home was refinanced. I just recently lost my job and cannot refi my home. She is threatening to place a lien on my home. Does she have legal right to do so? and she on her own, is doubling the interest rate and claims if I don't pay it, a lien will be placed....
need advice... |

If there were no other terms then she has to wait till you try to re-fi again. She would not likely win in court. But you have to reasonably try to re-fi at some point and must make good faith efforts to pay her. She cannot arbitrarily increase interest by the way without an agreement in advance.
