Default HOA and Leasing issues

Hi,
I have a question and am hoping you may be able to help. Do you have knowledge on Home Owner's Association issues?

My sister and I own two condos in a community that is controlled by the HOA. I do not have a Leasing Permit on one of the condos and I have a Tenant. I live in the other condo with my sister. The HOA has sent me a violation letter stating that the tenant has to vacate by June 24 because I have violated the rules. I read the Condo doc's and it states that I can have a roommate if I am living in the same condo with that person and that is our primary residence.

So, if I move into the unit with her and she lives there as my roommate, I should be okay. They said that they are investigating this and if she is still living there exclusivly, then they will evict her.

So, my question is, after I move in, how will they prove that we are roommates and that I am living there? What steps can they take to investigate this?? Can they invade my privacy? The President of Board of Directors lives on my floor and the unit that I currently live in belongs to my sister, so I may always be going over to her place, so how will they know that I now have moved to be roommates with my friend (who has been my tenant)?

Any consultation would be greatly appreciated!

They can check public info but cannot get any private personal information.

They could talk with neighbors etc.
