Default Timeshare Special Assessment

My husband and I have a timeshare at Divi Little Bay in St. Martin. I
listed the State/Country as Non U.S., however, Divi Resorts is a North
Carolina based company.

They have hit all the owner with a special assessment fee on top of the
maintenance fee. It is to cover beyond the renovation of our unit, but also
their conversion of the hotel into more timeshares.

I have read thru my contract several times. Although it clearly state the
maintenance fee and it\'s appropriate increase, it does not mention anything
regarding their right to charge such a fee.

What, if any, are my rights in this situation.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.

I am also a timeshare owner and have purposely delayed doing anything with this .... out of anger and frustration. I just googled Divi and Legal and saw your writein below. What did you decide to do?
