Default Lying roommate

My planned roommate has lied to me and left me in a contract alone. After planning for months with this guy and turning down numerous other potential roommates, he just today backed out only a week before the lease begins.

He misled me into sending in my $800 deposit and signing the lease. Meanwhile, he never sent his deposit in (despite telling me "the check's in the mail") and never signed the lease. The process was the housing company sent the lease to me, I signed it and returned it, then they mailed it to him. I can only assume that it is still there.

At this point, the housing company is telling me that they won't refund the deposit. So, can I force this sleazebag to pay the cost of my deposit? If not, can I claim that there never truly was a contract, since both tenants didn't sign?

Based on what you say here, you could file suit against him (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to his behavior...

His oral agreement with you can still be be binding. I agree sue him in small claims. Your lease is valid though as to the landlord.
