Can You do a Quit Claim on a house with both are names on the deed without being divorce???
Reason is, we been apart for 24 years.. We are going to get a uncontested divorce but, in New York State it will take awhile.. I am worries that Medicaid will put a lien on the house because of the cost of a medical procedure my X had to have..... X is willing to quit claim since X have no money invested into the house... There is no mortgage on the house.. The house will go to are son but we don't want to have any Liens for our son to worry about.... Thank's hope you can Help or steer me in the right direction...Thank's again |

You can quitclaim at any time but you should also check with a financial planner as tax issues may exist and you may not be able to avoid creditors with such a transfer in some cases.
