hello,
I paid a Florida realtor upfront commision for a year lease. The tenant paid first and security. He has lived in the unit a total of three months and has not paid rent in two. He is in the process of being evicted. Can I sue the realtor for the commision, we never did a contract because she is a freind of a freind. If you are wondering a credit check was never preformed on the tenant. Please advise. |

That really depends on what you agreed.
It is true you did not get a great tenant but it is also true that the realtor did do their job by getting somebody that you permitted. |

I'm almost on the same situation as yours but mine was worst.
I specifically asked for a good screening, he did a background check, put this woman in my house without a security deposit, without a full 1st month rent and then 3 months later, I was told by the realtor the woman will not pay rent ever, until a sheriff comes and evict her, in washington state that process could take months, this woman is a scam artist and knows she can get away with it. I asked for the background report from the realtor and sure enough this woman had a long history of being sent to court for none paying of debts spanning from 1998 - 2006. I hired a lawyer costing me $1000, we started the process in Feb but the next available date for a hearing was Apr, got a judgement for eviction, the woman won't leave, have to call a sheriff, have to schedule a sheriff within 10 days after asking, finally woman left May 8 and she have a free 3 months of living in my house inwhich I paid $1300 a month of mortgage plus $300 of utilities every month. I checked my house, carpet was so dirty, trash and garbage all over the place, they made my house like a pig's pen. We need to know how to sue this negligent, incompetent realtors and be held liable. help! |
