A father has sued his daughter for not being able to keep up on her payments. They are both on title and both on the loan but he demanded that a lease agreement be signed when we purchased the property in 1999. A settlement was issued for her to sign a quitclaim deed and the house be sold. Since then he has paid her the 20k that the settlement was for but has not paid the additional 5k for leaving the home clean and undamaged. The home has still not been sold and he moved his new wifes parents into the home instead of selling it. Now we need to find a good real estate law attorney in southern california to advise us of how to proceed with a counter suit against him and a possible fraud suit against his attorney.

What are you suing for actually...has she been paid? Is she supposed to get home sale proceeds still?
