easement ffor city utility line
Please help!! I am taking a business law class. I have a subject is to
Compare the proposed resolution of the civil aspects of the situation with the criminal acts resolution. The problem is Your team is working as a legal team in a mid-size law firm. Your supervisor, a partner in the firm, has been approached by Mr. Al Jones, a land developer and very important client, with the following legal situation: Mr. Jones's projects include some of the largest residential subdivisions within the City. While Mr. Jones' business was developing the infrastructure of its newest and largest subdivision, the City discovered an easement for a city utility line on the subdivision that did not belong to Mr. Jones. The owner of the property where the utility easement is located also discovered the error. The City is threatening to close down the subdivision and Mr. Jones's business, and is threatening to sue Mr. Jones for fraud against a municipality. The adjacent property owner is also threatening to sue the client for damages to his property and for trespassing. The adjacent property owner is a citizen of Switzerland. For my understand, Mr Jones didn't do anything wrong, the location for a city utility line need to be set and approve before the developer start building the subdivision. Why the city is suing Mr. Jones? I also think the adjacent property owner don't have the right to sue. Because the easement is next to his property, so they have to pass through to get to the utility line. Please let me know if i am on the right direction . thank you |

Vivian isn't cheating. She very clearly state that she is in a Business law class and is looking for affirmation on whether her originally deductions on the problem are on the right track. I believe this is an integral part of brainstorming. That is, you present your assumptions on a problem and ask for feedback on the same.
She clearly stated that from her understanding, Mr. Jones didn't do anything wrong and so on... She has already provided initial solutions to some of the issues, so she is obviously not trying to buy an answer but asking for feedback. As far as I am concerns that is engaging in an intelligent exchange. |
