Default verbal agreement beach access

We bought a home in a small coastal city on the west coast in Nov 2006. We were given a verbal agreement that our beach access (from our neighborhood) was to be started Jan 2008 at the latest. Things have fallen through with this and we no longer have a guarantee that we will have one at all. If we do it will be about 6 months down the road. Just wondering if we have a case against the developer? Our house is not worth what we paid for it without this beach access and if it does happen it is taking much longer than we were told.
