Need help and advise to claim refund for non-delivery
1)I paid $3890 usd to company X ( multi-national registered in delaware usa) on Dec 04 2007 for software and customization. Company X acknowledged payment but did not send receipt. I had to email them numeruos times before I finally got receipt. 2) company X installed software on my hosting account and "started" customization 3) Dec 12 2007 they informed me install was complete but were still working on customization 4) I emailed them on numerous occasions requsting the software and license key 5) After waiting for almost one month without getting email, download link or an account access for software and license key. I requested a refund because of non delivery of product and license key 6)On Jan 02 I emailed company X to formally request a refund 5)Only then did company X reply informing me customization was completed 7) I emailed company X on 03 Jan 2008 to them this was unacceptable formally requesting a refund again because of non-delivery of software and license key 8) 04 Jan 2008 company X email me license key ( after twice emailing them for refund and one month after paying them $3980) They also me informed that license was upload to my hosting account durung installation. *********** This is not true . I locked hosting account on Jan 02 2008 . I examined all files and that license key ( or any other) was not there which they now emailed me. *********** I am and fustrated and have lost confidence with company X. The only thing I have got for payment of $3980 usd is excuses, delays and no delivery of product and services which I paid for . Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
